1. Acceptance of Terms

By accessing our website (kitadental.com.au), submitting an enquiry, booking a consultation, or receiving treatment at Kita Dental, you agree to be bound by these Terms and Conditions. If you do not agree, please discontinue use of our website and services.

These Terms apply to all visitors, patients, and anyone who interacts with Kita Dental through any channel, including in person, by phone, by email, or via our website or social media.

2. About Kita Dental

Kita Dental Pty Ltd (ABN 86 651 571 890) is a dental clinic located in Mascot, with a strong focus on dental implants and cosmetic veneers. Our treating practitioner holds a Master of Implantology and is registered with the Dental Board of Australia through AHPRA.

All treatment at Kita Dental is performed by or under the direct supervision of our principal treating practitioner at our single Sydney clinic location.

3. General Information Disclaimer

Content on our website and across our social media channels — including text, images, videos, and case studies — is provided for general informational purposes only. It does not constitute dental, medical, or professional advice of any kind.

While we take care to ensure accuracy, we make no representations or warranties regarding:

  • The completeness or currency of any information published
  • The suitability of any described treatment for your individual circumstances
  • Specific outcomes, timelines, or results from any procedure

Any reliance you place on our website or marketing materials is at your own risk. A formal diagnosis and treatment recommendation can only be made following an in-person consultation with our treating practitioner.

4. Consultations and Treatment Planning

A consultation with Kita Dental is an opportunity to assess your clinical suitability for treatment. It does not constitute a guarantee of outcomes or a binding commitment by either party to proceed.

Treatment plans, fee estimates, and timelines provided following a consultation are valid for 30 days from the date of issue unless otherwise stated, and may be subject to revision based on clinical findings at the commencement of treatment. 

All treatment decisions are made collaboratively between the patient and our treating practitioner. Patients are encouraged to ask questions and seek independent advice before proceeding.

5. Appointments, Cancellations & Deposits

5.1  Appointments are subject to availability. Kita Dental reserves the right to reschedule appointments where clinically or operationally necessary and will provide reasonable notice.

5.2  A deposit may be required to secure certain bookings, including implant and cosmetic treatment appointments. Deposit amounts will be confirmed at the time of booking.

5.3  Our cancellation policy is as follows:

  • Cancellations with more than 48 hours notice: deposit refunded in full or transferred to a new appointment
  • Cancellations with less than 48 hours notice: deposit may be forfeited
  • No-shows without prior notice: deposit forfeited and a rebooking fee may apply 

5.4  Kita Dental reserves the right to decline future bookings from patients who repeatedly cancel or fail to attend without notice.

We understand that life happens. If you need to cancel or reschedule, please contact us as early as possible and we will do our best to accommodate you.

6. Fees, Quotes & Payment

6.1  All fees are quoted in Australian dollars (AUD) and are inclusive of GST where applicable. 

6.2  A written treatment plan and fee estimate will be provided following your consultation, where necessary. Final fees may vary from estimates where clinical circumstances change the scope of treatment.

6.3  Payment is required in full prior to or on the day of treatment, unless a formal written payment arrangement has been agreed with Kita Dental in advance.

6.4  We accept cash, EFTPOS, credit card, and approved third-party dental finance plans. Credit card surcharges may apply.

6.5  Private health insurance claims are processed via HICAPS where applicable. The patient is responsible for any gap amount not covered by their fund. Kita Dental does not guarantee any specific benefit entitlement from your insurer.

6.6  Credit card and banking details are not stored by Kita Dental. All payments are processed securely through our payment provider.

7. Treatment Outcomes Disclaimer

Dental implant and cosmetic veneer treatments involve inherent risks and individual variation in outcomes. Results depend on factors including bone quality, healing capacity, oral hygiene, general health, and patient compliance with post-operative care instructions.

Before and after images, case studies, and testimonials featured on our website or social media reflect individual patient outcomes at Kita Dental. They are illustrative only and do not guarantee equivalent results for any other patient.

Our treating practitioner will discuss the specific risks and benefits of your proposed treatment at your consultation, and written informed consent will be obtained before any procedure commences.

8. Superannuation Access for Treatment

Some patients may be eligible to access their superannuation on compassionate grounds to fund dental implant treatment under the Australian Taxation Office (ATO) Compassionate Release of Superannuation (CRS) program.

Superannuation access for dental treatment is strictly regulated by the ATO. Eligibility is assessed independently by the ATO on a case-by-case basis. Kita Dental does not approve, influence, or guarantee any application outcome.

Our role is limited to providing the supporting clinical documentation required for your application — including a treatment plan, clinical justification, and itemised fee estimate. We cannot advise on ATO eligibility or processing timelines.

Patients are strongly encouraged to:

  • Review current ATO eligibility criteria at ato.gov.au before applying
  • Seek independent financial advice before using superannuation funds for dental treatment
  • Consider all other available payment options (savings, health insurance, dental finance) before applying for superannuation release 

ATO processing decisions and timelines are entirely outside Kita Dental’s control.

9. Patient Images & Testimonials

All patient photographs, videos, and testimonials are used with the express consent of the individuals involved. Consent for the use of your images or testimonial in our marketing may be withdrawn at any time by contacting us in writing.

Patient images used in our materials are of actual Kita Dental patients unless otherwise stated. Results shown are individual and do not represent guaranteed outcomes.

10. External Links

Our website may contain links to third-party websites, including health funds, specialist referrers, and payment providers. These links are provided for convenience only and do not constitute endorsement or affiliation.

Kita Dental is not responsible for the content, accuracy, or privacy practices of any external site. We encourage you to review the terms and privacy policies of any third-party website you visit.

11. Intellectual Property

All content on kitadental.com.au — including text, images, logos, videos, and branding — is the intellectual property of Kita Dental or its licensors and is protected under Australian copyright law.

You may not copy, reproduce, modify, or commercially exploit any content without prior written permission. Limited permission is granted to print or save content for personal, non-commercial use only, provided the source is acknowledged.

12. Communications & Marketing

By submitting an enquiry or booking form, or by providing your contact details at the clinic, you consent to being contacted by Kita Dental via phone, SMS, or email in relation to your enquiry or appointment.

We may also contact you with:

  • Appointment reminders and clinical recall notifications
  • Post-treatment follow-up communications
  • Information about our services or promotions (where you have not opted out)

You may opt out of marketing communications at any time by replying STOP to any SMS, using the unsubscribe link in any email, or by contacting us directly. Opting out of marketing will not affect your clinical or appointment communications.

13. Limitation of Liability

To the maximum extent permitted by Australian law, Kita Dental is not liable for any indirect, incidental, or consequential loss arising from:

  • Reliance on website or marketing content prior to a formal in-person consultation
  • Treatment outcomes that differ from expectations where appropriate clinical care has been provided and informed consent obtained
  • Temporary unavailability of our website or booking systems

Nothing in these Terms limits any rights you have under the Australian Consumer Law, including consumer guarantees that cannot be excluded for services supplied to individuals.

14. Force Majeure

Kita Dental will not be liable for delays or failures caused by circumstances beyond our reasonable control, including but not limited to government directives or public health orders, laboratory or supplier delays, natural disasters, pandemics, or network and system outages.

In such circumstances, we will contact affected patients as soon as reasonably practicable to reschedule or discuss alternative arrangements.

15. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. Any dispute will first be referred to good-faith negotiation. If unresolved, it will be subject to the jurisdiction of the courts of New South Wales.

 For complaints relating to clinical care, you may also contact the Health Care Complaints Commission (HCCC NSW) at hccc.nsw.gov.au. For privacy-related complaints, you may contact the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au.

16. Changes to These Terms

Kita Dental may update these Terms at any time. The current version will always be available at kitadental.com.au/terms. Continued use of our website or services after any update constitutes your acceptance of the revised Terms.
